Terms of use

These terms apply to trial access and subscriptions to Pregame Studio and Pregame Arena (the “Software”), which is owned and operated by Beisik ehf., Icelandic reg. no. 440402-2750 (“Beisik”). By applying for trial access, signing in or using the Software, you accept these terms on your own behalf and on behalf of the club or company you represent.

1. Intellectual property

The Software is protected intellectual property. All rights in it belong to Beisik and are protected by the Icelandic Copyright Act No. 73/1972 and other intellectual property law. This includes the source code, design, interface, templates, graphics, text, functionality and structure of the Software.

The user is granted only a temporary, non-transferable right to use the Software for the duration of the trial or subscription. No ownership rights in the Software pass to the user.

2. No copying

The user acknowledges that they are being given access to protected proprietary software and that copying it, in whole or in part, is strictly prohibited. Without Beisik’s written consent, the user may not, among other things:

• copy, reproduce or imitate the Software, its design, interface, templates or functionality
• develop, or have others develop, a similar solution based on what the user learns from the Software
• reverse engineer or disassemble the Software, or otherwise try to obtain its source code
• sell, rent, lend or give a third party access to the Software

3. Access

Access is personal. The user is responsible for keeping their login details secret and for all use that takes place through their account.

4. Trial access

Trial access lasts 7 days. During the trial all content is watermarked and cannot be downloaded. Content made during the trial may not be published.

5. User content

The club keeps ownership of the data and content it uploads, such as logos, images, videos and information about players and advertisers. The club warrants that it has the right to use this content and permits Beisik to process it only to provide the service.

6. Breach of these terms

If the user breaches these terms, in particular sections 1 and 2, Beisik may close their access without notice. Beisik reserves the right to seek an injunction and damages for any loss caused by the breach.

7. Personal data

Beisik processes personal data in accordance with the Icelandic Data Protection Act No. 90/2018. Information from a trial application is used only to set up access and to prepare a subscription quote.

8. Changes

Beisik may change these terms. Changes are announced to users before they take effect.

9. Governing law

These terms are governed by Icelandic law. Any dispute about them shall be brought before the Icelandic courts.
